Waiver and Release of Liability, Assumption of Risk & Indemnity Agreement

          In consideration of permitting myself or my child to participate in the jet skiing and boating or other watercraft activity. I for myself and on behalf of my child, my personal representatives, heirs and next of kin do the following:

1. I hereby acknowledge that jet skiing and boating is a potentially dangerous activity and involves the risk of serious injury and/or death and/or property damage. While safety procedures and personal discipline will minimize this risk, the risk of serious injury does exist. This includes all watercraft activities.

2. I fully understand and acknowledge that (a) risks and dangers exist in myself and my child’s participation in jet skiing and/or boating; (b) myself and my child’s participation in watersport related activities and/or use of a jet ski and/or boat may result in injury, or damage to personal property, including the potential for permanent disability and death; (c) these risks and dangers may be caused by the watercraft operator, or other participants or by accidents, or by forces of nature or other causes. Risks and dangers may arise from foreseeable and unforeseeable causes including but not limited to: the selection of the water riding area, weather conditions, and such other risks, hazards and dangers that are integral to recreational activities that take place in a wilderness, outdoor or recreational environment. This includes all watercraft activities.

3. I understand that the activity of jet skiing is physically and mentally intense. I have instructed myself, my child and all riders in the importance of knowing and adhering by the rules, regulations and procedures established for the safety of jet ski participants and other water activity participants and I, my child and all riders have agreed to do so.

4. I hereby release, waive and discharge Hudson Marina and Hudson Marina Rentals, its owners, directors, officers, employees and agents (the Releases) from all liability to myself or my child, my personal representatives, all assigns, heirs and next of kin for any and all loss or damage and any claims or demands therefore on account of injury and/or death to myself or my child and/or property damage, now and forever, arising out of, or related to participation and/or instruction, activities or any other related to jet ski and other watercraft operations that may occur, whether caused by the negligence of the releases or otherwise.

5. I hereby assume full responsibility for any risk of bodily injury, death or property damage, now and forever, arising out of or related to participation and/or instruction, activities, or any related jet ski and other watercraft operations, whether foreseen or unforeseen and whether caused by the negligence of the Releases or otherwise. I hereby separately agree to indemnify and save and hold harmless the Releases from any loss, liability, damage or cost that may incur, now and forever, arising out of, or relating to myself or my child’s participation and/or instruction in said activities or any other related jet ski and other watercraft activity whether caused by negligence of the Releases or otherwise.

6. I hereby acknowledge that this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releases, and is intended to be as broad and inclusive as permitted by the laws of Alabama and that if any portion there of is held invalid, it is agreed that the balance shalt, notwithstanding, continue in full legal force and effect.

7. I have read this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement, fully understand its terms, understand that I have given up substantial rights by signing it, am aware of its legal consequences, and have signed it freely and voluntarily without any inducement, assurance, or guarantee being made to me or my child and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

8. I hereby certify that I, as parent/guardian with legal responsibility for all participants, do consent and agree not only to his/her release of Hudson Marina and Hudson Marina Rentals, and all other Releases but also agree to release and indemnify the Releases from any and all liabilities incident to his/her involvement in these activities for myself, my child, my personal representatives, my heirs, assigns, and next of kin.

20' Pontoon Policies

No rental vessel is allowed out in the Gulf. Avoid going under any of the major bridges.

Customers must give a 1 hour notice of cancellation if cancellation protection was purchased in order to receive a full refund (minus the price of the protection). Any No-Shows will be charged the full rental price.

Drivers need to have a valid driver's license in order to operate the vessel.

Must be 21 or older to rent, and renter must be with the rented vessel at all times.

Fuel will be charged upon return. The vessel is sent out with a full tank of fuel. It will be filled up once returned at Market Price per gallon.

Customer is responsible for any and all damages. Please inspect the watercraft before departure. If you prepurchased damage protection, it will cover up to that amount and you will still be responsible if there is any difference left.

Weather conditions will be assessed at the time of your rental. Not even the weatherman can accurately predict exact weather patterns in our area.

Overnight rentals require that customers have access to a dock at the vacation rental. The vessel does not need to be returned to the marina until the last day of the rental reservation. Please check with your rental property prior to making any reservations.
